5. Item 40 of his DA Form 20 does not show any wounds and item 41 lists the same awards as the DD Form 214. The Vietnam Casualty Roster does not contain the applicant's name.

 

6. The applicant's service medical records contain a 10 April 1967 entry that indicates he had injured his left knee when he dove under a truck during a mortar attack. Examination revealed abrasions which were treated and a grinding behind the kneecap that suggested a fracture. An X-ray examination was ordered, but the results are not contained in the available records.

 

7. The copies of medical records, which the applicant submitted, contain the above entry, but there is none that reflects treatment for a wound incurred through a grenade accident. The applicant did not indicate any such entry.

 

8. Army Regulation 600-8-22 provides, in pertinent part, that the Purple Heart is awarded for a wound sustained while in action against an enemy or as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.

 

9. Army Regulation 600-8-22 also authorizes a bronze service star, based on qualifying service, for each designated campaign listed in Appendix B of the regulation and states that authorized bronze service stars will be worn on the appropriate campaign or service medal. A silver service star is authorized in lieu of five bronze service stars. The regulation also lists the designated campaign periods for which a bronze service star is authorized for wear on the Vietnam Service Medal. The applicant served during the following two designated campaign periods: Counteroffensive Phase ll,1 July 1966-31 May 1967; and the Counteroffensive Phase lll,1 June 1967-29 January 1968.

 

10. Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register shows that 2nd Battalion, 32nd Artillery Regiment was awarded the Meritorious Unit Commendation, the Republic of Vietnam (RVN) Gallantry Cross with Palm Unit Citation and the RVN Civil Actions Honor Medal First Class Unit Citation for periods that included the applicant's tour of duty.
