Re: Your VA Appeal to U.S. Court of Appeals for Veterans Claims Dear Mr. Rowland,

As we discussed in a telephone conversation a few weeks ago, we have been successful in obtaining a remand of the November 7, 2006 decision of the Board of Veterans Appeals which denied your claim for entitlement to service connection for post-traumatic stress disorder. Accordingly, the parties have recently entered into a Joint Motion for Remand of your claim to the Board of Veteran's Affairs for readjudication. (See Attached)

This remand - which serves as an acknowledgment by VA that it made an error in considering your claim -enables you to submit evidence or argument in further support of your claim for VA benefits which the BVA must consider before readjudicating your claim. If you have any new evidence (that post-dates the Board's decision) which would assist your claim for PTSD such as new medical or treatment records, please submit it to the VA. On remand, the VA must correct the errors noted in the Joint Motion for Remand. Specifically, the Board must ensure that VA fulfills its duty to assist you by obtaining all of your record from the Boise Veterans Center.

Pursuant to the representation agreement that we executed at the commencement of our attorney-client relationship, our representation of your VA claim ceases now that your claim has been successfully remanded by the Court. As such, representation of your claim will return to your previous representative at the agency level.

Enclosed with this letter you will find your VA claim's file which we were able to obtain on your behalf. Please safeguard these documents as they represent your one free copy from VA. On behalf of Bergmann & Moore, it has been our sincere pleasure to represent you at the U.S. Court of Appeals for Veterans Claims. Should you have any questions regarding the contents of this letter or the attachment, please feel free to contact us. Otherwise, as noted above, please direct all further inquiries regarding your VA claim to your representative at the agency level.
